§ 2-3-40. Town Attorney.

  • (a)

    Appointment. The Board of Trustees at its first regular meeting after each biennial election shall appoint a qualified attorney at law as the Town Attorney and shall fix the Town Attorney's compensation. In case a vacancy should occur in the office of the Town Attorney, the Board of Trustees shall appoint a Town Attorney for the unexpired term.

    (b)

    Duties. The duties of the Town Attorney shall be as follows:

    (1)

    Act as legal advisor to, and be attorney and counsel for, the Board of Trustees and be responsible solely to the Board of Trustees.

    (2)

    Advise any officer or department head of the Town in matters relating to his or her official duties when so requested by the Board of Trustees; and file with the Town Administrator/Clerk a copy of all written opinions given by the Town Attorney.

    (3)

    Prosecute ordinance violations, conduct cases in Municipal Court and file with the Town Administrator/Clerk copies of such records and files relating thereto.

    (4)

    Prepare or review all ordinances, contracts, bonds and other written instruments which are submitted to the Town Attorney by the Board of Trustees; and promptly give his or her opinion as to the legal consequences thereof.

    (5)

    Call to the attention of the Board of Trustees all matters of law and changes or developments therein, affecting the Town.

    (6)

    Perform such other duties as may be prescribed for the Town Attorney by the Board of Trustees. (Prior code 2.06.01, 2.06.02; Ord. 11-2007 §1)
