§ 10-7-70. Prohibition of sale to or possession of tobacco products by minors.

(a)

No person shall, within the Town give, sell, distribute or offer for sale to any person who is under eighteen years of age any cigarettes or tobacco products.

(b)

No person under eighteen years of age shall, within the Town, possess any cigarettes or tobacco products.

(c)

As used in this section, unless the context otherwise requires:

(1)

"Cigarette" shall have the same meaning as set forth in § 39-28-202(4), C.R.S.

(2)

"Possession" means that a person:

a.

Has or holds any amount of cigarettes or tobacco products anywhere on his or her person;

b.

Owns or has custody of cigarettes or tobacco products; or

c.

Has cigarettes or tobacco products within his or her immediate presence and control.

(3)

"Tobacco product" shall have the same meaning as set forth in § 18-13-121(5), C.R.S.

(d)

Violations. Section 10-1-40 of the Town Code is amended to provide that a violation of the forgoing section 10-7-50 shall be a noncriminal violation.
