§ 6-4-40. Application review; issuance of license.

  • (a)

    After receiving an application, the Town Administrator/Clerk, within thirty (30) days, shall provide the Planning Commission with a written recommendation for approval or denial and the reasons for any recommendation of denial. Said recommendation shall be served on the applicant by certified mail at the address listed in his or her application.

    (b)

    The Planning Commission, at its next regularly scheduled meeting, shall, after referral of the application by the Town Administrator/ Clerk, consider the application for a favorable or unfavorable recommendation to the Board of Trustees. The applicant shall appear before the Planning Commission and respond to questions presented by the Planning Commission to determine the applicant's knowledge of the operation of a mobile home park. The questions may be presented to the applicant in written form prior to the Planning Commission meeting. In any event, the applicant may appear before the Planning Commission to refute any adverse recommendation of the Town Administrator/ Clerk. Upon a majority vote of approval or denial, the Planning Commission shall refer said application to the Board of Trustees, along with a record of all matters concerning said application. Said referral and record shall be written and shall be served on the applicant by certified mail at the address listed in his or her application.

    (c)

    The Board of Trustees, at its first regularly scheduled meeting following referral of the application by the Planning Commission, shall, by a majority vote, grant the application and issue a license to the applicant if it finds that:

    (1)

    The application has been properly completed.

    (2)

    The applicant is financially responsible, is adequately familiar with the laws and regulations under which the applicant must operate and, if not the owner of the mobile home park to be operated, is properly authorized by the owner to operate the mobile home park.
