§ 17-1-40. Plat and other approval expiration.

  • (a)

    Unless the Town Board otherwise specifically grants extensions, or provides otherwise, any plat, including:

    (1)

    Any Final Plat,

    (2)

    Any plat, plot or replat approved by the Town Board under any prior land use provisions of the Town Code or any prior version of the Town Code,

    (3)

    Any minor subdivision plat, or

    (4)

    Any annexation or annexation map which has not, within the later of:

    a.

    January 1, 2010, or

    b.

    One year from the date of final approval by the Town Board,

    Been properly submitted for recordation, including being executed by all owners and proprietors as defined by CRS § 31-23-111, with payment of all fees and all other submissions or requirements as set forth in the Town Code or the approving ordinance, shall be deemed expired and any Town Board approvals shall be deemed lapsed and resubmission and reconsideration of the development or plat application by the Town Board shall be required.

    (b)

    No conditional approval of a plat as described in this section shall toll the required one year submission period; rather, unless the Town Board otherwise specifically provides, any condition must be satisfied within the one year submission period.
